Terms of Use

These Terms of Use ("Terms") govern your use of the I Have A Voice mobile application ("the App") and the website at ihaveavoice.app ("the Site"). By downloading, installing, accessing, or using the App or the Site you agree to these Terms. If you do not agree, do not use the App or the Site.
In these Terms, "we", "us", and "our" refer to the providers of I Have A Voice. "You" and "your" refer to the person using the App or the Site, or, where the App is operated on behalf of a person with a communication impairment, to that person and their caregiver jointly.
1. The App
I Have A Voice is an Augmentative and Alternative Communication (AAC) tool that helps people compose text and have it spoken aloud, including through hands-free input such as eye and facial gestures. It is provided for personal, non-commercial communication use.
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for your personal communication purposes. All rights not expressly granted to you are reserved.
3. Subscriptions and in-app purchases
The App offers optional paid features through auto-renewable subscriptions sold via the Apple App Store. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions at any time in the Settings app on your device under Apple ID > Subscriptions.
Where a free trial is offered, any unused portion of the trial is forfeited when you purchase a paid subscription. Prices and currencies are shown in the App at the point of purchase and may vary by territory.
Refunds, where available, are handled by Apple in accordance with App Store policies. We do not process payments directly and cannot issue refunds for App Store purchases.
4. Permitted use
You agree to use the App and the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of, anyone else. You agree not to:
- copy, modify, reverse engineer, decompile, or disassemble the App except to the extent permitted by applicable law;
- circumvent or interfere with any security, licensing, or access-control feature;
- use the App or the Site to send unlawful, harmful, or harassing communications;
- use the App or the Site in any way that could damage, disable, overburden, or impair our systems or those of any third-party service we rely on.
5. Accessibility and not a medical device
The App is designed as a communication aid. It is not a medical device, does not provide medical advice, and is not intended to diagnose, treat, cure, or prevent any condition. If you or someone you care for has a medical condition that affects communication, consult a qualified healthcare professional. We do not guarantee that the App is suitable for any particular individual or clinical scenario.
6. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. By using the App or the Site you acknowledge the data practices described there.
7. Intellectual property
The App, the Site, their content, design, and underlying software are owned by us or our licensors and are protected by intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property rights to you. The text, custom phrases, and other content you create within the App belong to you; you grant us a limited licence to process that content solely as necessary to provide the App's features and as described in the Privacy Policy.
8. Third-party services
The App relies on third-party services - including Apple's App Store and operating system, Google Firebase and Google Cloud, and other infrastructure providers - to deliver its features. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for third-party services or for changes those providers make to them.
9. No warranty
The App and the Site are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free from harmful components, or that defects will be corrected.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the App or the Site, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
11. Changes to the App and to these Terms
We may update the App, the Site, and these Terms from time to time. When we make material changes to these Terms, we will update the "Effective" date at the top of this page and may also provide an in-App notice. Your continued use of the App or the Site after the updated Terms take effect constitutes your acceptance of them. If you do not accept the updated Terms, you should stop using the App and the Site and uninstall the App.
12. Termination
You may stop using the App at any time and uninstall it from your device. We may suspend or terminate your access to the App or the Site if you materially breach these Terms or where required by law. Sections that by their nature should survive termination - including those on intellectual property, disclaimers, limitation of liability, and governing law - will survive.
13. Governing law
These Terms are governed by the laws of England and Wales, without regard to its conflict of laws principles. Subject to mandatory consumer protections that may apply in your country of residence, the courts of England and Wales will have non-exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
14. Apple-imposed terms
To the extent the App is distributed through the Apple App Store, you also agree to Apple's standard end user licence agreement and acknowledge that Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms, with the right (and deemed to have accepted the right) to enforce these Terms against you. This section does not give Apple any additional rights against us.
